Is military leave counted as FMLA leave?

If the employee needs time off because of a family member’s military service, the absence might be protected by the FMLA. If, however, the employee personally needs time off to perform military service, that leave is not protected under the FMLA, but rather, is protected under the Uniformed Services Employment and Reemployment Rights Act (USERRA).
